TOP > How to order > Service agreement Once you have read and understood the "Rental Rules" information below, please press the "Agree" button and proceed to the application form. 1) Scope of contract: The duration of this agreement is for the rental period specified in the Cellular Phone Rental Application Form (hereinafter "Cellular Phone Rental Agreement"). Extensions are possible only where the contractor (or Signatory if signed by a corporation) submits an application for extension prior to the termination of the Cellular Phone Rental Agreement. Rental fees paid at the time of application are not refundable in cases where rental phones are returned before the termination of the rental period. In cases where there are delays in returning a rental phone or any other equipment, we may take the following actions: If your return of equipment is delayed: 1) For more than 24 hours, then we will stop service. 2) For more than 48 hours, then we will report your phone as lost or stolen, and automatically charge you a fee of $150. 2) Regarding loss, theft or damage Should you experience loss of, theft of or heavy damage (total loss) to the cell phone and accessories that you have rented from our company, please be sure to report it to us within the regular business hours. If the cell phone and accessories have been lost or stolen, you will be charged their actual retail costs. (If you buy the insurance coverage, you will be charged the deductible amount of $50.) If the cell phone and accessories are damaged, you will be charged for the cost of repairing the damage. (If you buy the insurance coverage, the repair is free.) Additionally, you will be charged for the rental fees and charges for all calls made during the contract period and for the period until such loss or theft is reported. 3) Payment Guaranty As a general rule, all payments must be made with a check or credit card. If the renter (applicant) is a corporation (or an individual that is different from the user), we will have a representative of the corporation or the user provide the payment guaranty as well. If you do not pay our invoice past its due date (or, in case of payment with a credit card, if the credit card cannot be used for settlement) we will have you agree to pay our company the penalty for late payment of the usage fee at the actual annual rate of 14% (on the basis of 365 days per year) and the related costs (attorney's fees, etc.). 4) Scope of Liability: Note that in some limited areas, you may be unable or have difficulty using our service due to interference. (Please contact our representative for more details. Please note that fees paid at the time of application are not refundable.) In addition, even in service areas, there may be limitation/interruption of service due to regional situations, strikes, government actions, or causes beyond TEMCO's reasonable control, and in such cases we can not predict these situations, restore service and/or refund. It is recommended that you use regular telephones for important matters, as our service is vulnerable to monitoring. We do not assume any liability for problems or damages incurred by the use of our service. Please note that if you have not received your equipment by the appointed date, we must be notified, or you may still be liable for the rental fees. If you did not receive rental cellular equipment by the day of rental commencement date due to your circumstances, there shall be no refund of claimed rental fee. Also, you should use our prepared waybill for return shipment, as our shipping and handling charges will still be assessed in the event that you make your own return shipment arrangements. 5) Cancellation Cancellation fee ($18) will be applied in case you cancel your reservation also shipping fee will be added to cancellation fee after the day of shipment. 6) Special Restrictions: We cannot be held responsible if you change the settings on your cellular phone. The cellular phone number we assign you is temporary, and we request that you treat it as a temporary number. Also, please observe all local restrictions on cellular phone use, such as prohibitions on use in flight or in hospitals. We prohibit making any changes to the settings of our rental cell phones outside the scope of the user manual, and prohibit the listing of their phone numbers in printed materials available to the public. In the case of a GSM-type cell phone, if the SIM card is detached, we will charge four times our regular call fee in addition to $300 as a fine for violating the agreement. 7) Jurisdiction For any legal dispute concerning this agreement, the Superior Court of the State of California will be used as the court with the original jurisdiction. *SSL (Secure Sockets Layer)is a security method for protecting contents of web communication using data encryption technology. Please be aware that, however, subject to the type of your browser, this service may not be provided.
